3. PERIOD OF DEVELOPMENT

From April 15, 2024 to December 24, 2024 (with drawing starting on January 10, 2025 on a date to be determined with the Chamber official in charge).

Merchandise prizes can be collected from Feb. 01 until March 30, 2025, while stays and dinners can be enjoyed, by prior arrangement, no later than March 30, 2025.

The store called “Enoteca Berta” located at 34 Via Guasti, Frazione Casalotto, 14046 Mombaruzzo (AT).

5. ENTITLED PARTICIPANTS

All persons over 18 years of age who purchase the products on sale and use the services at the above-mentioned businesses will be eligible to participate.

6. OPERATION OF THE PRIZE COMPETITION

Operational staff in the aforementioned stores will hand out to purchasers intending to participate in the contest, directly at the checkout counter when issuing the receipt or invoice, a coupon for participation in the contest for every €25.00 spent including VAT with a minimum expenditure of €25 including VAT (€25 to €49 expenditure= 1 ticket, €50 to €74 expenditure= 2 tickets, and so on).

For spending amounts made in one lump sum multiples of €25.00 (including vat), purchasers will receive as many coupons (e.g., €100.00= 4 postcards), while intermediate amounts (e.g., €190.00) will be calculated by default (i.e., equal to €175.00 corresponding to 7 postcards) and not in excess (€200.00, 8 postcards). The difference is not cumulative.

The postcard consists of two parts, matrix and daughter, both marked with a preprinted identifying, progressive and unique number.

The postcard stub has a space for entering the contest participant’s data, to be filled in by the contestant in block letters and legibly, and must be mailed into the appropriate receptacles before leaving the premises. Coupons that are not complete with all required data and coupons that are not legible will not be considered valid for the drawing.

The “daughter” card should be carefully kept by the purchaser along with the firmly stapled receipt corresponding to the purchase for which the card was received. In the case of a receipt with a multiple amount of 25.00 euros vat included, or intermediate of multiples, this must be stapled to all the daughters received for the corresponding purchase (e.g. 180 euros vat included receipt entitling to 7 cards must be stapled and presented together with them in case of winning).

Possession of the coupon and the purchase receipt are mandatory conditions and necessary to collect the prize. Should the winner be unable to collect the prize in person, he/she may delegate a person he/she trusts to collect the prize by providing, in addition to the winning coupon, the tax receipt of purchase, the signed proxy and a photocopy of a valid ID.

7. EXTRACTION

The draw will take place in the presence of a Chamber Official in charge of the protection of public faith.

In addition to the drawing provided for in these regulations, a drawing of No. 10 reserve names will also be held, which will be used in order of drawing in the event that:

  • the winner was untraceable
  • there is no formal acceptance of the prize by the winner
  • the prize is not withdrawn within the time limit stipulated in these regulations.

In turn, the reserve nominees will be able to collect the prize they were awarded by April 30, 2025. After this deadline, uncollected prizes will be donated to the relevant non-profit organization. (see item 13 of these regulations). The prize may not be transferred to third parties.

Prizes will be delivered to the winners no later than March 30, 2025 at the office at 34/36 Guasti Street, 14046 Mombaruzzo (AT).

If at the time of delivery the prizes are not available in the described models, they will be replaced by others of the same nature and/or similar value.

9. RESPONSIBILITIES RELATED TO THE USE OF AWARDS

No responsibility is attributable to DISTILLERIE BERTA in case of misuse by the winners of the above prizes or from the use made by persons unsuitable for age or psycho-physical conditions.

10. METHOD OF COMMUNICATION OF WINNINGS AND DELIVERY OF PRIZES

Notification of winning will be sent to the participant by e-mail, or by registered mail if no e-mail address has been provided, and will be notified by telephone if a telephone number has been provided. The prize must be collected by the winner upon verification of the winner’s identity and the regularity of the daughter card with the relevant receipts. The winner who could not or would not take advantage of the prize will not be entitled to any money either in gold tokens or once received, replaced by another product.

11. CLAIM OF AWARDS NO LONGER AVAILABLE ON THE MARKET OR CHANGED FROM THOSE PROMISED

The winner, once the prize has accrued, may not in any way demand that the prize originally indicated and depicted, for the sole purpose of presentation, on the advertising material submitted to him/her in advance, be equally delivered in the form if this is not, at the time of the request available. He will therefore be paid a prize of the same nature for the same value.

12. METHODS FOR PARTICIPATING IN THIS PRIZE MANIFESTATION

Participation in this sweepstakes event implies for the participant, the unconditional and total acceptance of the rules and clauses contained in these rules without limitation. Participation in this event is free and completely free of charge with the exception that the procedures for participation expressed in these regulations are followed.

13. AWARDS NOT RECEIVED OR NOT AWARDED

In accordance with Presidential Decree No. 430 of 26/10/2001, any prizes not awarded or not requested will be donated to the non-profit organization Projeto Corumbà.

14. REVOCATION OF THE PROMISE OR MODIFICATION OF THE MODE OF EXECUTION

Distillerie Berta may revoke or change the manner in which this Sweepstakes is carried out for good cause by giving prior notice to the contestants in the same or equivalent form as the promise.

15. WAIVER OF REVOCATION

Distillerie Berta declares that it waives its right to reclaim the winners’ withholding tax, ex art.30 Presidential Decree 600/1973

16. MEDIA USED FOR ADVERTISING THIS AWARD MANIFESTATION

Press campaign and local media. The means of communication for disseminating the contest to recipients will be consistent with these regulations.

17. PROCESSING OF PERSONAL DATA

Participants adhering to this initiative, agree that the personal data provided to DISTILLERIE BERTA I in relation to participation in the initiative itself will be treated in accordance with the D.L. 196 of 30/06/2003, without prejudice in any case for the participants, the right to be able to exercise their rights under art.7 of the above law.

18. FULFILLMENTS AND GUARANTEES

  • Winners of the drawing will be notified within 30 days of winning.
  • Berta Distilleries reserves the right when awarding prizes to verify that the winners are indeed the recipients of the event.
  • Prizes will be awarded upon verification of the regularity of the cards and their receipts.
  • The drawing of the winners will take place in the presence of a Chamber of Commerce Official in charge.
