Buying Guide

Giving an experience through https://www.distillerieberta.it/en/experiences-and-tour/ is very simple: just go to the page and select the desired experience; You will be able to select whether to receive a Voucher for one or two persons (selection not available for packages including stays)and finally add the desired vouchers to the cart, choosing the quantity.


You can then proceed to add new products or go directly to the shopping cart by clicking on the corresponding symbol to finalise your purchase;


In the shopping cart you will see all the products you have added and you can choose to remove the ones you entered incorrectly; if all the products are correct, continue by clicking on Proceed to Order. Vouchers will be sent immediately after payment to the e-mail address entered in the box provided;

 

For each purchase, you will need to provide us with your billing details by entering them in the appropriate boxes; For companies based in Italy, the addressee code or pec must be entered for e-invoicing purposes; Please check that the billing information you have entered is correct before finalising your purchase as you will not be able to request a change;

 

At this point you can choose your payment method and confirm your purchase;
The order confirmation will be sent by email to the email address indicated at the time of purchase;

 

General terms and conditions of sale

The offer and sale of gift vouchers (hereinafter referred to as ‘Vouchers’) on our website https://www.distillerieberta.it/en/experiences-and-tour/ are governed by the following General Terms and Conditions of Sale.

 

Vouchers purchased on https://www.distillerieberta.it/en/experiences-and-tour/ are sold directly by DISTILLERIE BERTA SRL (hereinafter referred to as “Seller”), with registered office in Italy, at VIA GUASTI 34/36 14046 MOMBARUZZO (AT), VAT and C.F number IT01283390050.

All information required by applicable law, or by the nature of the contract, concerning each individual contract concluded throughwww.distillerieberta.it/visite-e-degustazioni/esperienze-tour/ including, but not limited to, the main characteristics of the goods or services, their price (including taxes), additional shipping, delivery or postal charges and any other costs, the method of payment, the time of delivery of the goods or execution of the order, the duration of the contract, if any, the minimum duration of the consumer’s obligations, shall be specified in the order form to be accepted and sent electronically by the consumer, with the express acknowledgement by the consumer that sending the order entails an obligation to pay;

The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 6 September 2005; 206, on the Consumer Code in Chapter I ‘Of Consumers’ Rights in Contracts’, with specific reference to the regulation of distance contracts, and by Legislative Decree 9 April 2003 no; 70 on certain aspects of electronic commerce;

1. Commercial Policy 

  1. The Seller offers for sale, on https://www.distillerieberta.it/en/experiences-and-tour/, services and carries out its electronic commerce activity exclusively towards its end users hereinafter referred to as “Customers”.
  2. These General Terms and Conditions of Sale exclusively regulate the offer, submission and acceptance of purchase orders of products on www.distillerieberta.it/visite-e-degustazioni/esperienze-tour/ between the customers of DISTILLERIE BERTA SRL and the Seller.
  3. On the other hand, the General Conditions of Sale do not regulate the provision of services or the sale of products by parties other than the Seller that are present on www.distillerieberta.it/visite-e-degustazioni/esperienze-tour/ through links, banners or other hypertext links.
  4. We advise you, before placing orders and purchasing products and services from parties other than the Seller, to check their terms and conditions of sale, as the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of e-commerce transactions between users of https://www.distillerieberta.it/en/experiences-and-tour/ and third parties.
  5. In this regard, it should be noted that Vouchers can be purchased exclusively at https://www.distillerieberta.it/en/experiences-and-tour/, by email at info@distillerieberta.it or by phone at +39 0141 739528 . The seller assumes no responsibility for purchases and sales of vouchers between third parties or between individuals.

2. Concluding a contract

    1. To conclude the contract for the purchase of one or more products on https://www.distillerieberta.it/en/experiences-and-tour/, you must complete the order form in electronic format and transmit it to the Seller, electronically, following the relevant instructions.
    2. Before proceeding to the purchase of the products, through the transmission of the order form, you will be asked to carefully read the General Conditions of Sale and the Information on the right of withdrawal. We will also provide you with a summary of the commercial and contractual conditions that we propose for the purchase of the vouchers, in which there is a cross-reference to the General Conditions of Sale and a summary of information on the essential characteristics of each voucher ordered with its price (including all applicable taxes or fees), the means of payment that you can use to purchase each voucher, the method of delivery of the vouchers purchased, the way in which the professional handles complaints, the shipping and delivery costs; as well as the references and geographical and e-mail address of the Seller. In addition, the Vendor will provide you with a summary of the terms and conditions for exercising your right of withdrawal and how and when to return purchased products (taken from the Return Form). You will, in addition, be provided with information about the circumstances under which you will lose your right to withdraw from the contract.
    3. In the order form, displayed immediately prior to the conclusion of the purchase agreement, we will provide you with summary information about the essential characteristics of each voucher you order, the price (including all applicable taxes or fees) and the shipping costs (including any additional costs incurred by you for choosing a different and/or faster type of shipping and delivery than standard shipping and delivery). The contract is concluded when the Vendor receives, electronically, your order form, after verifying that the information relating to your order is correct.
    4. The order form will be stored in our database for the period of time necessary to process orders and otherwise within the terms of the law. You will be able to access your order form by going to the My Order section.
    5. When you proceed to submit your order form you will be advised that such submission implies an obligation to pay the price indicated. Before proceeding with the transmission of the order form, you will also be asked to identify and correct any data entry errors.
    6. The languages available to conclude the contract with the Seller are Italian and English.
    7. By submitting your order form electronically, you unconditionally accept and agree to abide by these General Terms and Conditions of Sale in your dealings with Seller. If you disagree with any of the terms in the General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on https://www.distillerieberta.it/en/experiences-and-tour/
    8. By submitting an order form, you confirm that you understand and accept the General Terms and Conditions of Sale and the additional information contained in https://www.distillerieberta.it/en/experiences-and-tour/ also referred to through links, including the General Terms and Conditions of Use and the Privacy Policy and Right of Withdrawal Policy.
    9. Once the contract is concluded, the Seller will send you, by e-mail, a receipt of the purchase order, containing the General Conditions of Sale and the summary document on the Right of Withdrawal and therefore, all the information already contained in the summary of the commercial and contractual conditions displayed before proceeding to purchase.

3. Payments and returns

    1. For the payment of the price of the products and related shipping and delivery costs you can follow one of the ways indicated in the order form. In no event will you be charged any costs in excess of those actually incurred by the Seller in connection with your chosen means of payment.
    2. Electronic payments are processed through Stripe. Stripe has been audited by a PCI-certified auditor and has been certified as a PCI Level 1 service provider. This is the most rigorous level of certification available in the payments industry. For more information, see https://stripe.com/docs.
    3. Financial information (e.g., the number of the credit/debit card or the date of its expiration) will be forwarded, via encrypted protocol, to Banca C.R.Asti or other banks, which provide the relevant remote electronic payment services, without third parties being able, in any way, to access it. Such information, moreover, will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any returns of products, following the exercise of your right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on https://www.distillerieberta.it/en/experiences-and-tour/
    4. If you are a consumer (i.e., “the natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried on,” as it is defined by Art. 3 lett. a Legislative Decree 206/05), you have the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day of the conclusion of the contract described in 2.5, 2.7 and 2.8.
    5. The right of withdrawal will no longer be exercisable once the service has been enjoyed, which, before the expiration of 14 days from the conclusion of the contract, can only be done at your explicit request, and with express acceptance that the early enjoyment determines the loss of the right to withdraw (art. 59 lett. a D. Lgs 206/05); the right of withdrawal will also not be provided for the service called “picnic” once you have provided us with an indication of the date on which the service will be enjoyed (art. art. 59 lett. n D.Lgs 206/05), given that depending on this indication we will have to promptly procure the supply of perishable foodstuffs for the preparation of the requested service;
    6. To make a return, you are required to inform us of your decision to withdraw from this contract by an explicit statement (e.g., letter sent by mail or email).
    7. The declaration of withdrawal – we provide you in attachment to these general conditions of sale the sample model for this purpose prepared by the same Legislative Decree 206/05 (art. 49 lett. h) – must be sent to one of the following addresses, by mail or e-mail:

8. You will be refunded all payments you have made to us, with the exception of delivery costs, without undue delay and in any case no later than 14 days from the day we are informed of your decision to withdraw from this contract. Such refunds will be made using the same means of payment used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a consequence of such a refund.

9. In case of gift or fruition of the voucher by a third party, we inform you, and in any case it is agreed herein, that the only subject entitled to the right of withdrawal, and therefore holder of the right of credit having as its object the reimbursement of the sums paid for the purchase of the voucher, is the contractor, that is, the subject who has formulated the relative order, which we will identify in the same way as the data entered in the fields prepared for this purpose on the site;

4. Extension of the Voucher

  1. Only vouchers that have not yet expired and have not yet been used will be eligible for extension. The extension provided is for an additional 6 months from the expiration date shown on the voucher, and vouchers cannot be extended more than once.
  2. To extend a voucher, simply email info@distillerieberta.it, specifying voucher number, order number and your explicit intention to extend the voucher: the extension is free of charge.
  3. In case of extension of vouchers, the conditions of usability accepted at the time of purchase of the extended voucher remain unaffected, insofar as they are compatible.

5. Regolamento di utilizzo del voucher

      1. The service will be provided only after the voucher is presented and subject to availability.
      2. Therefore, it is necessary to follow the rules on reservations.
      3. Unless otherwise explicitly imprinted or written on the vouchers, whether virtual or ordinary, they are valid for 12 months, unless extended, from the date of issuance, after which time the right to use the services permanently lapses.
      4. Failure to take advantage – through the presentation of the relevant voucher within its maximum period of validity (as said of 12 months) – of the services purchased constitutes conduct contrary to fairness and good faith, sanctioned with a penalty equal to 85 % of the price paid, which the seller is hereby authorized to withhold, at the expiration of the aforementioned period of 12 months, from the sums received on account of price, and without the need for any further warning or notice; the seller will then solicit once, at the e-mail addresses registered at the time of the order, a response from the customer regarding the confirmation of the destination where to direct the reimbursement of the remaining 15% of the price received at the time, without these sums producing, in the relationship between the parties, any interest whatsoever. In the absence of feedback, the seller will still proceed as already indicated in paragraph 3.7 for the case of withdrawal.

      5. In the case of more than one service included in the same voucher these must be used on the same occasion of use; without prejudice to the hypotheses and procedures provided by law for the purposes of the right of withdrawal, no reimbursement will be recognized for the case of voluntary non-use of one or more services that the seller has nevertheless made available.

7. Foro competente

  1. In the case you are a consumer, according to what is seen in point 3.4, for any dispute will be competent the Judge of the place where you have residence or domicile as established by D.Lgs 206/05; on the other hand, if you are not a consumer, it is agreed that competent for any dispute that may arise from this contract and the related negotiations – as well as for the stipulation, interpretation and execution of the contract by way of example only – with the exclusion of any other different Court, the Court of Asti.

  2. Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the following clauses, which are specifically and separately “flagged” and referred to below, are deemed to be specifically signed a second time
